Proposed Gypsy/Traveller Site on 40 Acre Field: Planning Appeal Update
The Public Planning Inquiry conducted by the Planning Inspectorate commenced, as advised, on 11th July at 10.00am. 3 days had been set aside for the Public Inquiry. At extremely short notice the Appellants advised the Planning Inspectorate that they would not be able to attend on the 11th July. The Planning Inspector advised that the Public Inquiry would take place as planned and that all parties should attend. Witnesses and legal and planning representatives of The Claygate Community Group, which includes Claygate Parish Council and Elmbridge Borough Council’s witnesses and legal representatives were in attendance. The Appellants and their representative were not in attendance.
Consequently, the Planning Inspector, after outlining the options, decided that in fairness to all he would determine the planning appeal based on all written submissions from all parties previously submitted, ‘given the absence of the appellant or any representative thereof today and given the agreed likelihood that the Inquiry would not be completed in the remaining two days and the general need to progress the appeal’.
He then closed the Inquiry at around 12.30 am on the 11thJuly. The Planning Inspectorate have since advised that a decision is expected on or before 8th September 2017.
